Amendment to the Building Act 2026: What (Does Not) Stay and How to Prepare

The new Building Act became fully effective on 1 July 2024, and you may remember that everyone was trying to submit their building permit applications in June to avoid the new rules. The digitalisation of building permitting procedures was also supposed to be launched on the same date. We all know how that turned out – the system is currently operating under a so-called bypass arrangement, with the original system running alongside the remnants of the new digital system.
The new government has now introduced an amendment to the Building Act, which partly returns to the so-called Klára Dostálová version, i.e. the original form of the new Building Act. That version, however, never entered into force, as it was substantially amended into the form we have been working with since 2024. This is not, however, a step backwards, nor is it merely a change to the structure of the building authorities – the amendment introduces many more changes to the Building Act.
In the meantime, the amendment has already passed the Chamber of Deputies and is now before the Senate. Along the way, however, it has changed so significantly that it is worth reading the current text rather than the original proposal: the effective date has been postponed from 1 July 2026 to 1 January 2027, the new system of authorities at regional and local level will not begin operating until 1 January 2028, and some of the mechanisms originally included in the proposal have been dropped altogether.
