There is, of course, the possibility of settling out of court, but such a settlement is only possible if the worker's liability is acknowledged to have led to the injury or death. Also, such an agreement must be approved by the insurance company of the provider where the doctor or other medical professional works. But this too carries its own risks, such as future claims by family members, for example. This amount may then be higher than the insurance coverage.
